Jackson Browne sues McCain over Song Use Infringement

Jackson Browne sues McCainPresidential Nominee John McCain and the Republican party are being faced with a law suit from singer/songwriter Jackson Browne. John McCain and party used Browne’s 1978 hit song “Running on Empty” in a recent television commercial without permission.

The suit was filed in United States District in Los Angeles, California. Browne is claiming that McCain and party did not receive permission to use his song, “Running on Empty”, for a TV ad in which, “Senator McCain and the Republicans mock Democratic candidate for President Barack Obama for suggesting that the country conserve gas through proper tire inflation.”

Being a lifelong Democrat, Browne is seeking a undisclosed amount in damages as well as a permanent injunction prohibiting the use of “Running on Empty” in any form relating to the McCain or Republican campaign.

“Not only have Senator McCain and his agents plainly infringed Mr. Browne’s copyright in ‘Running on Empty,’ but the Federal Courts have long held that the unauthorized use of a famous singer’s voice in a commercial constitutes a false endorsement and a violation of the singer’s right of publicity,” says Browne lawyer Lawrence Iser.
